Seller in Columbus gun ring stages hunger strike
LAS CRUCES - A gun collect owner alleged to have sold weapons that made it into the hands of Mexican cartels has entered into a ravenousness strike after alleging he's been denied legal and media visitation at the Doña Ana County Internment Center.
Ian Garland, 51, pleaded guilty in July to federal charges of collusion and six counts of making false statements in the acquisition of firearms. He attempted to recoil his guilty plea in December, but on Jan. 24, U.S. District Court Pass sentence Robert Brack denied the request. He has not been scheduled for sentencing, where he faces up to 35 years in brig.
The Sun-News requested visitation with Garland on Thursday and was told Friday that a MP could meet with him in person this upcoming week.
In a Jan. 19 letter to the Sun-Tidings, Garland writes that several other media outlets have tried to interview him, "and all have been denied." In to boot, a Dec. 24, 2011 visit by his attorney was "at the last minute, denied," he wrote.
"I have been in a 6-by-12 allowance for 316 days in maximum security for making legal and proper sales to people who have lied to me, they even admitted they lied, so why am I here?" he wrote Jan. 19.
Garland, an Australian aboriginal and a naturalized U.S. citizen, says he is incredibly proud to be an American - even marrying his mate on July 4, and signing his letter "God bless America" - and is flabbergasted at what has happened to him in the last year.
"I won't entreat to something I didn't do!" he wrote. "I want a jury to hear everything I have to say, the lies, threats, harassment."
In retort, Garland said he has informed jail staff he is on a hunger attack, which started Jan. 13.
"I want to be heard," he wrote. "I want justice, I requirement to save (my and my wife's) house, I'll die here before I eat this food again, I feed my pets safer. I have so much to tell about what is going on in here, my God, this is America, not a Soviet gulag. How can this be human? I'm a gentle being, not an animal. I won't eat until I'm heard."
Garland, the owner of Chaparral Guns in Chaparral, N.M., was one of 14 verge residents who entered into plea agreements in the case.
Between January 2010 and Stride of this year, the 15 defendants, headquartered in Columbus, allegedly conspired to smuggle about 200 firearms favored by Mexican cartels, at least entirely on the orders of Jesus "Mantequilla" Molinas, an inmate at Cereso federal cooler in Juárez.
Some of the weapons were allegedly found at the scenes of a murder, a kidnapping and a drug bust in Mexican fringe towns.
The defendants, including one who remains on the run, allegedly paid Crown's store, Chaparral Guns, about $70,000 for the AK-47-type pistols and American Adroit 9 mm pistols, with the potential to sell the firearms for three times that on the other side of the border.
In another missive, from Jan. 3, Garland wrote that he had "no idea" the Columbus police chief, mayor and village trustee were doing anything interdicted.
"I made legal and lawful sales to people who lied to me," he wrote. "What was I to think when they drove to my concern in uniform, in a police car, city cars, bring the mayor, police chief? I was forceful everyone how happy I was, they did the paperwork, passed the FBI background check, why would I not trust them?
"I told them, 'you can buy what you wish, but if these start turning up in crimes, or Mexico, you'll be in big trouble.' They said 'no imbroglio, they are for us.' I documented everything, above and beyond, I took photocopies of all documents, even though I was not required to. ATF came 18 months later, asked 'are you agonizing about them?' I said, 'of course not, they are officials, I have all the paperwork, serial numbers and sent in my multiple reporting forms to the sheriff and ATF as required.' I ask should I traffic in more? They said yes."
In his request to withdraw his plea, Garland said he felt "he was pressured into mendacious to himself and pleading guilty," to the count, and that "the pressure and potential consequences of not pleading were too much and this calculated him to plea(d) to Count 1, the conspiracy, when he otherwise did not believe in (his) heart that he was embarrassed."
The only defendant who is scheduled to go to trial is Gabrielle Gutierrez, the wife of former village trustee Ennuy "Woody" Gutierrez, who has already pleaded guilty in the case. She entered a not-blameworthy plea to the charges against her - conspiracy, two counts of making false statements in relations with the acquisition of firearms, and two counts of smuggling goods from the United States - on Nov. 1. Pest before Judge Brack in federal court in Las Cruces is scheduled for 9 a.m. on Feb. 13.
Gutierrez, who is lavish on conditional release pending trial, faces up to 35 years in jug if convicted on the charges.

•Manuel "Coruco" Ortega, 25, of Palomas, Mexico, pleaded blameworthy to firearms smuggling and conspiracy.
•Ricardo Gutierrez, 25, of Columbus, pleaded embarrassed to three counts of firearms smuggling, three counts of making false statements about acquiring firearms and collusion.
•Eva Lucie Gutierrez, 21, of Las Cruces, pleaded guilty to making untrustworthy statements about acquiring firearms and conspiracy.
•Brenda and David Christy, 54 and 55, of Deming, have pleaded apologetic to making false statements to a federally licensed firearms retailer.
•Ignacio "Nachito" Villalobos, 24, of Columbus, is on the run and remains charged with two counts of smuggling firearms and one upon conspiracy.
